Suspect in Fatal Show-Me's Shooting Released From Custody

FLORISSANT, Mo. (KMOX) - The suspect in a fatal Show-Me's shooting has been released from police custody.

The Florissant Police Department posted the news on its Facebook page Friday morning.

"By law an individual can’t legally be held in police custody when no charges are issued with-in 24 hrs," the post says.

The department has presented the case to the St. Louis County Prosecuting Attorney's Office, which has decided to take the case under advisement, but not issue any charges at this time, according to the department.

The attorney's office is reviewing the facts and circumstances surrounding the case, and the police department "will continue to work closely with them."

The shooting happened Wednesday afternoon at Show-Me's on New Florissant Road.

Scott Beary, 43, of Manchester, was shot several times in the torso, and he died on the scene. The other victim, 37-year-old Ryan Jacobsmeyer of Troy, was shot, treated and released from the hospital.
Police say the shooting stemmed from a disagreement inside the bar.

Just five days prior, Beary and his wife, Christy, buried their 2-week-old daughter, Jocelyn.

A GoFundMe page describes Beary as a "loving husband, father, brother, son and friend to many."

The alleged shooter hasn't yet been identified.
